This Online Conduct Policy ("OCP") sets out the terms and conditions under which you agree to utilise Jones and Palmer's systems, products, services and network. The OCP may be modified at any time at Jones and Palmer's sole discretion. All modifications and updates to this OCP are immediately effective for all clients. Failure to follow the terms and conditions of the OCP may result in termination of the Service. Service refers to the Hosting Services or other services provided to you by Jones and Palmer. Use of Jones and Palmer's Hosting Services, products or systems acknowledges and agrees to all terms and conditions contained herein.
1. USE
The OCP is designed to ensure that your use of the Service does not break any laws or interfere with the rights of other Jones and Palmer’s' clients who also to use the Service. The Hosting Services may only be used for lawful purposes and it is your responsibility to ensure that use of the Hosting Services complies with all applicable laws and regulations.
2. SECURITY
If you do not have authorisation, you must not:
- Access or attempt to access or use any data, systems or networks;
- Probe, scan or test the security of a system or network;
- Use any program, tool, or process designed to interfere with or disrupt the performance of systems or networks or to "crash" systems;
- Breach any security or authentication measures for a system or network; or
Attempt to gain access to the account of any other user.
3. INTERNET ETIQUETTE
You must not:
- Use any program, tool or other process designed to monitor the transmission of data or traffic across a network;
- Forge any TCP-IP packet header, any part of the header information or an email source address in an email or newsgroup posting;
- Provide false user information to Jones and Palmer or other users;
- Send large amounts of unsolicited or unwanted email to individuals or individual business accounts;
- Gain access to a person’s private information (or attempt to do so);
- Disobey the rules of any newsgroup, forum, email mailing list, bulletin board or other similar group; or post the same or similar messages to one or more newsgroups (including by excessive cross-posting or multiple-posting, also known as ‘spam’).
4. TECHNICAL OPERATION OF THE SERVICE
You must not attempt to interfere with the regular workings of Jones and Palmer’s systems or network connections. Jones and Palmer may override any attempt by you to specify a particular traffic routing pattern.
You must not attempt to modify, alter, reverse engineer, decompile, disassemble derived works based on Jones and Palmer’s proprietary information or software.
You must not impair the ability of other people to use Jones and Palmer’s systems or the Internet.
5. RIGHTS OF OTHER PERSONS
You must not break any laws or infringe the rights of other persons, including by:
- Distributing or making available any abusive, obscene, defamatory or pornographic material;
- Engaging in any activities that infringe the intellectual property rights of others, including but not restricted to using material which is protected by copyright without permission, using third party trade marks without permission and using and or distributing confidential information belonging to a third party without permission; and
- Engaging in activities that violate the personal privacy rights of others, including collecting and distributing information about users without their permission, except as permitted by applicable law.
6. BREACH OF THE OCP
Jones and Palmer may give details of users who are suspected of breaking any laws in connection with the Service to the police and to other law enforcement agencies.
Jones and Palmer may implement technical mechanisms to prevent behaviour which breaches the OCP (for example, which block multiple postings before they are forwarded to their intended recipients).
Jones and Palmer may exercise any rights it has under its contract with the client whose account is being used in breach of this OCP. Such rights include the right to suspend or terminate the client's use of the Service.
Jones and Palmer may take any other action it deems appropriate, including taking action against offenders to recover the costs and expenses of identifying them.
7. GENERAL
Jones and Palmer may at any time revise the OCP by updating them online. Since you are bound by the OCP, you should periodically visit this page, to review the then current OCP.
